In general, GBH convictions are the most serious assault charges. As the most serious form of attack, the results show this. Depending on the facts of the case and the level of damage, the starting point for the punishment can vary from 3 years to 16 years in prison.
Whether the GBH offense was committed recklessly or intentionally is a key factor for the court to determine the appropriate sentencing range.
Along with other factors such as risk level, the court will consider a range of options and decide whether alternative, non-custodial rehabilitation options are appropriate, compared to an immediate care period.

Deciding whether a risk should be considered serious or not is often a matter of independent judgement. This will often be the discretion of the prosecutor or investigation manager, although legal guidelines and tests are the basis for this assessment.
Risks to the suspect's health or well-being may constitute a "real" risk of abuse. Actual harm refers to the consequences of an assault, meaning that physical and psychological harm need only be minimal, but must be proven.

ABH cases can be dealt with in magistrates' courts or Crown Courts, as an offence. Where the case is dealt with will depend on its seriousness and the resulting consequences can range from community orders (if the person is found to be low risk) to 3 years imprisonment in the most serious cases dealt with by the Crown Court.
Common assault or battery usually involves the unlawful arrest of a person (where he has not quietly consented, that is, if he is nervous during a concert), but does not necessarily involve injury.
According to the law, ordinary violence or violence occurs where there is more than a casual or minor relationship. Neither the police nor the prosecution need to prove an accident. Normally - with certain exceptions - the prosecutor will choose not to prosecute the case in court if there is no damage at all, as it would not be in the interests of justice to do so.
In general, most minor assaults that cause minor injuries or no longer pain or suffering will be charged as common assault.
Abh Vs. Gbh
Common assault is the only "main charge" of assault which is summary only, meaning it can only be heard in a magistrates' court, unlike ABH offenses which can be heard in a magistrates' court or the Court of Appeal.
Where ABH is dealt with in a magistrate's court, it will usually be judged in the same way as ordinary assault, where the main factor for the assessment is the circumstances, as well as aggravating and mitigating factors. The maximum penalty for serious violence is 6 months' imprisonment, and the minimum penalty is the nominal penalty. This is usually around 50% of a person's weekly income.
